Additional features, revisions, changes, or requests outside the agreed project scope may require additional charges.

Blackstone Design Co. reserves the right to adjust pricing for additional work or future projects.

3. Payments

All projects require 100% payment upfront unless otherwise agreed upon in writing.

Work will not begin until payment has been received and cleared.

By submitting payment, the client agrees to these Terms and authorizes Blackstone Design Co. to begin work on the project.

4. Client Responsibilities

Clients agree to:

• Provide accurate project information.
• Provide required text, images, branding materials, and other content needed for the project.
• Respond to communication and requests in a timely manner.
• Ensure they have legal permission to use any content they provide.

Delays caused by missing information, unavailable materials, or delayed responses may affect the project timeline.

5. Revisions and Changes

The number of revisions included depends on the agreed project scope.

Requests that significantly change the original project requirements, design direction, or functionality may be considered additional work and may require additional payment.

6. Intellectual Property

Before full payment is received, all designs, code, concepts, files, and other project materials remain the property of Blackstone Design Co.

After full payment has been received, ownership of the completed website and agreed deliverables transfers to the client, excluding:

• Third-party software.
• Licensed fonts, images, plugins, frameworks, or other assets.
• Tools, systems, templates, or methods used by Blackstone Design Co. to create websites.

Blackstone Design Co. reserves the right to display completed projects in its portfolio unless a written confidentiality agreement has been made.

7. Third-Party Services

Projects may involve third-party services, including but not limited to hosting providers, domain registrars, analytics services, payment processors, fonts, APIs, and other software.

Blackstone Design Co. is not responsible for:

• Third-party service outages.
• Price changes.
• Policy changes.
• Security issues.
• Service interruptions caused by external providers.

8. Website Availability and Performance

Blackstone Design Co. works to provide reliable and high-quality websites but does not guarantee:

• Continuous website availability.
• Error-free operation.
• Specific search engine rankings.
• Increased sales, leads, traffic, or business performance.

Results may vary depending on factors outside of our control.

9. Limitation of Liability

To the fullest extent permitted by law, Blackstone Design Co. is not responsible for indirect, incidental, consequential, or special damages resulting from the use of our services.

This includes, but is not limited to:

• Lost profits.
• Lost business opportunities.
• Data loss.
• Website downtime.
• Business interruptions.

The maximum liability of Blackstone Design Co. shall not exceed the amount paid by the client for the specific project involved.

10. No Refund Policy

All payments made to Blackstone Design Co. are final and non-refundable.

Because every website project involves reserved time, planning, design, development, and custom work, refunds are not provided.

This includes, but is not limited to:

• Client cancellation.
• Change of mind.
• Delays caused by the client.
• Failure to provide required materials.
• Dissatisfaction after work has started.
• Project termination.

By purchasing services from Blackstone Design Co., the client acknowledges and agrees to this No Refund Policy.

11. Acceptable Use

Clients and website visitors may not:

• Use our website or services for unlawful purposes.
• Attempt unauthorized access to systems.
• Distribute malicious software.
• Copy or redistribute Blackstone Design Co. materials without permission.
• Use our services in a way that violates applicable laws.

12. Termination

Blackstone Design Co. reserves the right to terminate a project or refuse continued service when we determine that termination is necessary or appropriate.

Reasons for termination may include, but are not limited to:

• Failure to provide required information, materials, or feedback.
• Repeated delays preventing project completion.
• Violation of these Terms.
• Abusive, threatening, or unprofessional behavior.
• Requests that are unlawful or outside the scope of our services.
• Circumstances that make completion of the project impractical.

If Blackstone Design Co. terminates a project due to client actions, violations, or circumstances outside of our control:

• Payments already made will be retained.
• Payments will not be refunded.
• Blackstone Design Co. has no obligation to continue or complete the project.

13. Right to Refuse Service

Blackstone Design Co. reserves the right to refuse service to any individual or business at our discretion.

We may refuse or discontinue service for reasons including, but not limited to:

• Abusive or disrespectful behavior.
• Fraudulent activity.
• Illegal requests.
• Requests outside our capabilities.
• Situations that conflict with our business standards.

If service is refused before work begins, Blackstone Design Co. may issue a refund at its discretion.

If work has already begun, the No Refund Policy applies.
